ലോക്സഭ പ്രതിപക്ഷ നേതാവ് രാഹുൽ ഗാന്ധിക്കെതിരായ ഇരട്ട പൗരത്വ ആരോപണവുമായി ബന്ധപ്പെട്ട കേസിൽ എഫ്ഐആർ രജിസ്റ്റർ ചെയ്യാനുള്ള ഉത്തരവ് അല്ലാഹാബാദ് ഹൈക്കോടതി താൽക്കാലികമായി മാറ്റിവച്ചു. കൂടുതൽ വാദം കേൾക്കുന്നതിനായി കേസ് ഏപ്രിൽ 20-ന് വീണ്ടും പരിഗണിക്കും.
അല്ലാഹാബാദ് ഹൈക്കോടതിയിലെ സിംഗിൾ ബെഞ്ച് ജഡ്ജി ജസ്റ്റിസ് സുഭാഷ് വിദ്യാർത്ഥിയാണ് ഉത്തരവ് പുറപ്പെടുവിച്ചത്. കേസിൽ പ്രതിയായ രാഹുൽ ഗാന്ധിക്കു മറുപടി പറയാനുള്ള അവസരം നൽകേണ്ടതുണ്ടെന്ന് കോടതി നിരീക്ഷിച്ചു.
വെള്ളിയാഴ്ച നടന്ന കേൾവിയിൽ, അപേക്ഷകന്റെ വാദം കേട്ട ശേഷം എഫ്ഐആർ രജിസ്റ്റർ ചെയ്യണമെന്ന് കോടതി വാചാലമായി നിർദ്ദേശിച്ചിരുന്നു. എന്നാൽ പിന്നീട്, പ്രതിപക്ഷത്തെ കേൾക്കാതെ വിധി പറയുന്നത് നിയമപരമായി ശരിയല്ലെന്ന ഹൈക്കോടതി ഫുൾ ബെഞ്ചിന്റെ മുൻ വിധി ശ്രദ്ധയിൽപ്പെട്ടതിനെ തുടർന്നാണ് തീരുമാനം മാറ്റിയത്.
ബിജെപി പ്രവർത്തകനായ എസ്. വിഗ്നേഷ് ശിശിർ നൽകിയ ഹർജിയിലാണ് നടപടി. രാഹുൽ ഗാന്ധിക്ക് ബ്രിട്ടീഷ് പൗരത്വം ഉണ്ടെന്നാരോപിച്ച് എഫ്ഐആർ രജിസ്റ്റർ ചെയ്യണമെന്നാണ് ആവശ്യം.
തുടക്കം റായ്ബറേലി കോടതിയിലായിരുന്നു
കേസിന്റെ തുടക്കം റായ്ബറേലി എം.പി/എം.എൽ.എ കോടതിയിലായിരുന്നു. പിന്നീട് ഹർജിക്കാരന്റെ അഭ്യർത്ഥന പ്രകാരം കേസ് ലഖ്നൗവിലേക്ക് മാറ്റി. ജനുവരി 28-ന് ലഖ്നൗ കോടതി ഹർജി തള്ളിയതിനെ തുടർന്ന് ഹൈക്കോടതിയെ സമീപിക്കുകയായിരുന്നു.
വെള്ളിയാഴ്ച കോടതി വാദം പൂർത്തിയാക്കി എഫ്ഐആർ രജിസ്റ്റർ ചെയ്യാൻ നിർദ്ദേശം നൽകിയിരുന്നു. എന്നാൽ ശനിയാഴ്ച പുറത്തിറങ്ങിയ ഉത്തരവിൽ തീരുമാനം മാറ്റി. പ്രതിപക്ഷത്തിന് നോട്ടീസ് നൽകാതെ ഹർജി പരിഗണിക്കുന്നത് ശരിയല്ലെന്ന് കോടതി വ്യക്തമാക്കി.
ഇരട്ട പൗരത്വ ആരോപണം ഇതുവരെ തെളിയിച്ചിട്ടില്ല. അതിനാൽ ആരോപണം ഇപ്പോഴും പരിശോധിക്കേണ്ട വിഷയമാണ്.
നിലവിൽ കേസ് വീണ്ടും കേൾവിക്കായി നിശ്ചയിച്ചിരിക്കുകയാണ്. ഭാവിയിൽ കോടതിയുടെ അന്തിമ വിധി അനുസരിച്ച് തുടർ നടപടികൾ ഉണ്ടാകും.
