ന്യൂഡൽഹി: നിയമം അനുശാസിക്കുന്ന തരത്തിൽ സ്വന്തം വീട്ടിൽ പ്രാർഥനായോഗം സംഘടിപ്പിക്കുന്നതിൽനിന്നു വിലക്കുന്ന ഒരു നിയമവും രാജ്യത്തില്ലെന്ന് ഛത്തീസ്ഗഡ് ഹൈക്കോടതി. സ്വന്തം വീട്ടിൽ പ്രാർഥനായോഗം നടത്തുന്നതിന് ഒരു അധികാരിയുടെയും മുൻകൂർ അനുമതി ആവശ്യമില്ലെന്നും ഹൈക്കോടതി വ്യക്തമാക്കി. ക്രൈസ്തവ വിശ്വാസപ്രകാരമുള്ള പ്രാർഥനായോഗം നടത്തുന്നത് വിലക്കി ജാഞ്ച്ഗിർചമ്പ ജില്ലയിലെ നവഗഡ് പോലീസിൽനിന്നു ലഭിച്ച നോട്ടീസ് ചോദ്യം ചെയ്തു വീട്ടുടമസ്ഥൻ സമർപ്പിച്ച ഹർജിയിലാണു കോടതി നടപടി.
പൗരാവകാശങ്ങളിൽ ഇടപെടരുതെന്ന് പോലീസിന് നിർദേശം
ഹർജിക്കാരുടെ പൗരാവകാശങ്ങളിൽ ഇടപെടരുതെന്നും അന്വേഷണത്തിന്റെ മറവിൽ അവരെ ഉപദ്രവിക്കരുതെന്നും പോലീസിനോട് കോടതി നിർദേശിച്ചു. എന്നാൽ ശബ്ദമലിനീകരണമോ ക്രമസമാധാന പ്രശ്നങ്ങളോ ഉണ്ടായാൽ നിയമപ്രകാരം ആവശ്യമായ നടപടി സ്വീകരിക്കാൻ അധികാരികൾക്കു സ്വാതന്ത്ര്യമുണ്ടെന്ന് ഹൈക്കോടതി വ്യക്തമാക്കി.
വീട്ടിൽ പ്രാർഥനായോഗം നടത്തുന്നതിനെതിരേ മൂന്നു തവണ പോലീസ് ഹർജിക്കാരനു നോട്ടീസ് നൽകി
പ്രാർഥനായോഗം നടത്തുന്നതിന് ഹർജിക്കാർ മുൻകൂർ അനുമതി നേടിയിട്ടില്ലെന്നു ഛത്തീസ്ഗഡ് സർക്കാരിനുവേണ്ടി ഹാജരായ മുതിർന്ന പ്രഭാഷകൻ ചൂണ്ടിക്കാട്ടിയെങ്കിലും അത്തരമൊരു അനുമതിയുടെ ആവശ്യമില്ലെന്ന് കോടതി വ്യക്തമാക്കി. വീട്ടിൽ പ്രാർഥനായോഗം നടത്തുന്നതിനെതിരേ മൂന്നു തവണയാണ് പോലീസ് ഹർജിക്കാരനു നോട്ടീസ് നൽകിയത്. ഈ മൂന്ന് നോട്ടീസും റദ്ദാക്കിയതായി ഹൈക്കോടതി ഉത്തരവിൽ വ്യക്തമാക്കി. യോഗം നടത്തുന്നതിനു ബന്ധപ്പെട്ട അധികാരികൾ വീട്ടുടമസ്ഥന് എൻഒസി നൽകിയെങ്കിലും അതു പിൻവലിച്ചിരുന്നു. അത്തരമൊരു സർട്ടിഫിക്കറ്റിന്റെ ആവശ്യമില്ലെന്നു പറഞ്ഞ കോടതി, എൻഒസി പുനഃസ്ഥാപിക്കേണ്ട ആവശ്യമില്ലെന്നും വ്യക്തമാക്കി.
ആരാധനയ്ക്കായി ഒത്തുകൂടാനുള്ള അവകാശം ഉണ്ടെന്ന് മറ്റൊരു കേസിൽ അലഹബാദ് ഹൈക്കോടതി
രാജ്യത്തെ എല്ലാ മതവിഭാഗങ്ങൾക്കും ആരാധനയ്ക്കായി ഒത്തുകൂടാനുള്ള അവകാശം ഭരണഘടനയുടെ ആർട്ടിക്കിൾ 25 പ്രകാരം ഉണ്ടെന്ന് മറ്റൊരു കേസിൽ അലഹബാദ് ഹൈക്കോടതി നേരത്തേ നിരീക്ഷിച്ചിരുന്നു. പ്രാർഥനയുടെ മറവിൽ ഒരു വിശ്വാസം മറ്റൊരു വിശ്വാസത്തെ പ്രചോദിപ്പിക്കുന്നതിന് ഭരണഘടന സംരക്ഷണം നൽകുന്നില്ലെന്നും അലഹബാദ് ഹൈക്കോടതി ചൂണ്ടിക്കാട്ടിയിരുന്നു.
