ഛത്തീസ്ഗഢിലെ സർക്കാർ സ്കൂളുകളിൽ വിദ്യാർത്ഥികളെ ഹിന്ദു പ്രാർത്ഥനകൾ ചൊല്ലാൻ നിർബന്ധിക്കരുതെന്ന് ഹൈക്കോടതി വ്യക്തമാക്കി. സ്കൂൾ വിദ്യാഭ്യാസ വകുപ്പ് ജൂൺ 12-ന് പുറപ്പെടുവിച്ച സർക്കുലർ ചോദ്യം ചെയ്തുകൊണ്ടുള്ള ഹർജി പരിഗണിക്കവെയാണ് കോടതിയുടെ നിർണായക ഉത്തരവ്. പുതിയ അധ്യയന വർഷം മുതൽ സർക്കാർ സ്കൂളുകളിൽ ദിവസവും വേദമന്ത്രങ്ങൾ ചൊല്ലണമെന്ന് നിർദേശിക്കുന്നതായിരുന്നു വിവാദമായ സർക്കുലർ.
നിർബന്ധിതമാക്കരുതെന്ന് കോടതി ഉത്തരവ്
ജസ്റ്റിസ് അമിതേന്ദ്ര കിഷോർ പ്രസാദ് അടങ്ങിയ ബെഞ്ചാണ് ഹർജി പരിഗണിച്ചത്. ഗായത്രി മന്ത്രം, സരസ്വതി വന്ദനം എന്നിവ സർക്കാർ സ്കൂളുകളിൽ നിർബന്ധമാക്കാനുള്ള നീക്കത്തിനെതിരെ മുൻ ഛത്തീസ്ഗഢ് വഖഫ് ബോർഡ് ചെയർമാൻ അബ്ദുൽ സലാം റിസ്വി, മഹേന്ദ്ര ഛാബ്ഡ, സാമൂഹിക പ്രവർത്തകൻ ഷഫീഖ് അഹമ്മദ് എന്നിവരാണ് കോടതിയെ സമീപിച്ചത്. ഹർജിക്കാർക്കായി അഭിഭാഷകരായ ആമിർ ഖാനും സിതാര ഖാനും ഹാജരായി.
ഉത്തരവ് നടപ്പാക്കിയിട്ടില്ലെന്ന് സർക്കാർ
വിവാദ സർക്കുലർ സംസ്ഥാനത്തെ സർക്കാർ സ്കൂളുകളിൽ ഇതുവരെ നടപ്പാക്കിയിട്ടില്ലെന്ന് സർക്കാർ അഭിഭാഷകൻ കോടതിയെ ബോധിപ്പിച്ചു. ഈ വിശദീകരണം കണക്കിലെടുത്ത് കോടതി ഹർജി തീർപ്പാക്കുകയായിരുന്നു. എന്നാൽ, ഏതെങ്കിലും വിദ്യാർത്ഥിയെ മതപരമായ പ്രാർത്ഥനകളിൽ പങ്കെടുക്കാൻ നിർബന്ധിക്കുന്നതായി ശ്രദ്ധയിൽപ്പെട്ടാൽ ഹർജിക്കാർക്ക് വീണ്ടും കോടതിയെ സമീപിക്കാമെന്നും കോടതി വ്യക്തമാക്കിയിട്ടുണ്ട്.
ഭരണഘടനയുടെ 28-ാം അനുച്ഛേദം ചൂണ്ടിക്കാട്ടി ഹർജി
വിദ്യാഭ്യാസ വകുപ്പിന്റെ ഉത്തരവ് ഭരണഘടന ഉറപ്പുനൽകുന്ന മൗലികാവകാശങ്ങൾക്കും മതനിരപേക്ഷതയ്ക്കും വിരുദ്ധമാണെന്ന് ഹർജിക്കാർ വാദിച്ചു. ഭരണഘടനയുടെ 28-ാം അനുച്ഛേദം (Article 28) പ്രകാരം സർക്കാർ ധനസഹായം നൽകുന്ന വിദ്യാഭ്യാസ സ്ഥാപനങ്ങളിൽ മതബോധനമോ മതപരമായ പ്രാർത്ഥനകളോ നിർബന്ധമാക്കാൻ പാടില്ലെന്ന് ഹർജിയിൽ ചൂണ്ടിക്കാട്ടി.
രാവിലെ സ്കൂൾ അസംബ്ലിയിൽ ദേശീയഗാനം, ദേശീയഗീതം എന്നിവയ്ക്കൊപ്പം ദീപ മന്ത്രം, സരസ്വതി വന്ദനം, ഗുരു മന്ത്രം എന്നിവയും, ഉച്ചഭക്ഷണത്തിന് മുൻപായി ഭോജന മന്ത്രവും, ക്ലാസുകൾ അവസാനിക്കുമ്പോൾ ഗായത്രി മന്ത്രം, ശാന്തി മന്ത്രം എന്നിവയും ഉൾപ്പെടുത്താനായിരുന്നു വിദ്യാഭ്യാസ വകുപ്പ് നിർദേശിച്ചിരുന്നത്.
